Resolve by Agreement is an online portal, that allows users an efficient, secure and simple way to provide all the necessary information that is required to lodge their Consent Order Application forms.

What Can You Expect with Resolve by Agreement?

1. Application Form

We will ask you to complete a detailed online application form which will help us confirm and understand the fundamentals of your agreement and provide us with all the necessary information and personal details to finalise your paperwork legally. This will involve you (or you and your spouse together) answering a series of questions about each of you. The application will include topics such as Property Division, and ask what assets and liabilities you each hold, how much money you each earn, how much credit card debt you each have and things of that nature. For parenting orders, questions such as how much time each of you are spending with the children will be asked. Upon submission of the form, you will be guided to make a payment of 30% for your security and ours. By doing it this way, you save the time and cost associated with meeting with lawyers in order to capture this exact information, and you can do it all at your own pace and in your own environment.

2. Phone or Skype consult with a lawyer

Following receipt of this application, one of our lawyers will review your situation carefully and set up a phone or Skype call, to confirm the details of your agreement. At this time we will also carefully take you through the forms to ensure there is nothing missed and follow up anything that you may not have considered to ensure you have everything in place to protect you now and into the future. This may lead to us discussing things you may not have considered like spousal or child support matters or other legal entitlements you may have.

3. Review & Advice

The finalised documents will be sent to you for review together with a customised letter of advice and a letter for your spouse with the agreement. It will also include a letter to the superannuation fund (if necessary) with details of the proposed split. You will be guided to make final payment at this time.

4. Signed and submitted to the court

It is at this point that you now need to sign and arrange for your spouse to do so also. You can either choose to disengage from us and handle it yourselves from here by filing the documents in your local registry or we can handle the lodgement of the court documents and all the necessary communication with the superannuation fund and your spouse (for an extra fee). Either way, you will receive a letter from us with instructions on how to give effect to the agreement to make sure you comply with its terms and to give you piece of mind that the deal is done. We can also assist you with the divorce application process if that is applicable to you.

When does Resolve by Agreement Work?

Whatever the reason, Resolve by Agreement works because when you and your spouse have already reached an agreement in relation to the distribution of your assets and liabilities and/or the care arrangements for your children and you are looking to formalise this through the process of filing legal Consent Orders.
