There are two main types of child support arrangements.
- Child Support Assessment
If you decide that self-management is not suitable, you can apply for a child support assessment. This process involves a formal calculation of how much child support each parent should pay, which is determined based on factors such as income and care arrangements. Once the assessment is done, the Department of Human Services (Child Support) can also manage the collection and transfer of payments. This takes the burden off you and ensures everything is legally formalised.
- Self-Managed Child Support
Self-management means that you and the other parent decide together how much child support is to be paid, when it is paid, and how it is paid. While this option offers more flexibility, it also requires careful coordination between both parties. If you choose this route, you'll still need legal advice to ensure the arrangement is fair and that you're both clear on the financial details. Self-management also means you will only qualify for the base rate of Family Tax Benefit Part A.
- Child Support Agreement
Once you have a child support assessment, you may also choose to formalise the arrangement with a child support agreement. This agreement can cover various aspects, such as cash payments, non-cash items (like health insurance or school fees), or a combination of both.
There are two types of agreements:
Limited Child Support Agreement: Less formal, but still legally binding.
Binding Child Support Agreement: More formal and legally enforceable, providing stronger protection for both parties.
