What is divorce?

Divorce formally ends a marriage and requires you to show that the relationship has ‘irretrievably broken down.’

This is demonstrated by:

  • Being separated for at least 12 months, even if you’re still living under the same roof.
  • Showing there is no likelihood of the relationship resuming.

Who can apply for divorce?

You can apply for a divorce if you:

  • Are an Australian citizen, or
  • Consider Australia your permanent home, or
  • Have lived in Australia for at least 12 months before applying.

If you’ve been married for less than two years, you’ll need to attend counselling or get court approval before applying.

What about Superannuation?

Superannuation is often overlooked but is a significant asset. It can be valued and split between you, even though it remains subject to superannuation laws until retirement.

Separation under one roof: You can be legally separated and still live under one roof , it requires extra evidence.

Timeframes: Divorce orders usually take effect one month and one day after being granted, but the process can take longer if additional steps are needed.

Children and Property.

Divorce does not automatically resolve parenting or property matters. Issues such as child arrangements, financial support, and the division of assets need to be addressed separately, often alongside the divorce process.
