Navigating property settlements after separation.

Get the right legal advice early.

Dividing property after a relationship breakdown can be overwhelming, but you don’t have to face it alone.

Getting the right legal advice early can save you stress, protect your interests, and ensure you’re making informed decisions about your future. Here’s what you need to know—and how we can help.

What counts as property?

Property includes all your assets and debts, regardless of whether they’re in one name or both. This can include:

  • Your family home, cars, or investments
  • Cash, bank accounts, or superannuation
  • Business interests, family trusts, or inheritances
  • Debts like mortgages, loans, or credit cards are included in the consideration also.

Then a net position of available assets for division is established.

What if I wasn't the primary income earner, am I entitled to the assets? What if the property is in one name, do I miss out?

The answer to those questions is no.

All property is in the mix for division. It is then a question of careful consideration about contribution to those assets that will affect how they are split between you.

Timing matters

Acting quickly after separation is crucial. There are strict timeframes for applying for property orders:

Married couples: Within 12 months of your divorce becoming final
De facto couples: Within two years of separation

Missed these deadlines? You’ll need court permission to apply, which isn’t always granted.

How can property be divided?

While every situation is unique, property settlements consider factors like financial and non-financial contributions, caring responsibilities, and future needs. If you and your former partner can agree, you can

  • Create a financial agreement
  • Apply for legally binding consent orders

If agreement feels out of reach, we can help guide you through mediation or court proceedings to protect your interests.

What about superannuation?

Superannuation is often overlooked but is a significant asset. It can be valued and split between you, even though it remains subject to superannuation laws until retirement.

Proper advice ensures this complex asset is handled fairly.
